Microsoft Live Tile Patent Violation - Business Insider

Microsoft is being sued over the most visible new feature of Windows 8 and Windows Phone 8.

A company called SurfCast claims that Microsoft's Live Tiles, which actively update new information on the main screen as it is received, violates a patent it has.?

SurfCast filed the lawsuit with the?U.S. District Court in the District of Maine yesterday, October 30,?The Next Web?reported.

According to?its website, SurfCast says?it designs operating-system technology and has applied for four more patents.

The company designed a new concept referred to as "Tiles" for which it is suing Microsoft.

SurfCast describes its "Tiles" as?"dynamically updating icons," different from standard operating-system icons for files and applications because they are "selectable and live?containing refreshed content that provides a real-time or near-real-time view of the underlying information." That's?Patent?6,724,403, granted in 2004:??System and method for simultaneous display of multiple information sources.?

That does sound similar in concept to Microsoft's Live Tiles, which show information from users' email, calendar, and social networks, as well as other software and Web apps.

In the lawsuit, SurfCast references Microsoft's own patent,?Patent 7,933,632: ?Tile space user interface for mobile devices," which the software giant received in 2011.

Hurricane Sandy has already reduced refining capacity in the Northeast, and the possibility exists of extended outages if any of these refineries take significant damage from the hurricane. Gasoline and heating oil inventories in the area were already very low, and this increases the chances of sharp gasoline spikes across the area. However, these spikes are expected to be short-lived and localized, as the area also receives gasoline from Europe and from the?Colonial Pipeline, which brings supplies to the East Coast from the Gulf Coast. As long as refinery outages are not prolonged, the gasoline markets should return to normally fairly quickly. However, people would be wise to make sure their cars are topped off with gasoline and that their heating oil supplies are adequate.?

New York streets flooded as Sandy slams into eastern U.S.

NEW YORK (Reuters) - Sandy, one of the biggest storms ever to hit the United States, battered the nation's eastern seaboard on Tuesday, swamping New York City streets with record levels of floodwater, blacking out power to millions of people and bringing transportation to a halt through much of the region.

At least 13 people were reported killed in the United States by Sandy, which dropped just below hurricane status before going ashore in New Jersey on Monday, according to officials and media reports. More than 1 million people across a dozen states were under orders to evacuate as the massive system continued to plow westward.

One disaster forecasting company predicted economic losses could ultimately reach $20 billion, only half insured.

The storm also slowed the presidential campaign at a key time ahead of next week's vote and closed U.S. markets for two days.

Sandy, which was especially imposing because of its wide-raging winds, brought a record surge of almost 14 feet to downtown Manhattan, well above the previous record of 10 feet during Hurricane Donna in 1960, the National Weather Service said.

Water poured into the subway system and tunnels that run under the rivers around Manhattan, raising concerns that the world's financial capital could be hobbled for days to come.

"Hitting at high tide, the strongest surge and the strongest winds all hit at the worst possible time," said Jeffrey Tongue, meteorologist for the weather service in Brookhaven, New York.

Hurricane-force winds as high as 90 miles per hour were recorded, he said.

"Hopefully it's a once-in-a-lifetime storm," Tongue said.

Large sections of New York City were in darkness without power and transportation in the metropolitan area was at a standstill.

"In 108 years our employees have never faced a challenge like the one that confronts us now," Metropolitan Transportation Authority Chairman Joseph Lhota said in a statement.

It could take anywhere from 14 hours to four days to get the water out of the flooded subway tunnels, the MTA said.

"The damage has been geographically very widespread throughout the entire subway, bus, LIRR (Long Island Railroad) and Metro North system, MTA spokesman Aaron Donovan said.

50-PLUS HOMES BURN

The unprecedented flooding was hampering efforts to fight a massive fire in one of the city's barrier island neighborhoods, Breezy Point in the borough Queens, the New York Fire Department said. More than 170 firefighters battled a fire that destroyed more than 50 homes.

Two people were reported dead in New York City - a man in a house hit by a tree and a woman who stepped into an electrified puddle of water. Two other people were killed in suburban Westchester County, north of New York City, and a motor vehicle death in Massachusetts was blamed in part on the bad weather.

Two others were killed in Maryland in storm-related incidents, state authorities said, and deaths also were reported in Connecticut, New Jersey, Pennsylvania and West Virginia, CNN said.

Toronto police also recorded one death - a woman hit by flying debris.

Some 6.8 million people in several states were left without electrical power by the storm, which crashed ashore late on Monday near the gambling resort of Atlantic City, New Jersey.

In New Jersey, Exelon Corp declared an alert around its Oyster Creek nuclear power plant because of rising waters, the U.S. Nuclear Regulatory Commission said. Officials said if waters rose further, they might be forced to use emergency water supplies to cool spent uranium fuel rods.

An alert-level incident, the second-lowest of four action levels, means there's a "potential substantial degradation in the level of safety" at a reactor.

The storm's wind field stretched from South Carolina north to the Canadian border and from West Virginia to a point in the Atlantic Ocean halfway to Bermuda, easily one of the largest ever seen, the National Hurricane Center said.

Heavy snow fell in higher elevations of the Appalachian Mountain inland, and the population centers of Baltimore, Philadelphia and Washington, D.C., were in the slow-moving storm's path.

In New York, a crane partially collapsed and dangled from a 90-story luxury apartment building under construction in midtown Manhattan, and authorities evacuated residents in the area out of fear that high winds would bring the entire rig down.

Much of the city was deserted, as its subways, buses, commuter trains, bridges and airports were closed.

Neighborhoods along the East and Hudson rivers were underwater, as were low-lying streets near Ground Zero, where the World Trade Center once stood.

Power and back-up generators failed at New York University Hospital, forcing patients to be moved elsewhere for care.

In lower Manhattan, firefighters used inflatable orange boats to rescue utility workers stranded for three hours by rising floodwaters inside a power substation.

One of the Con Ed workers pulled from the floodwater, Angelo Amato, said he was part of a crew who had offered to work through the storm.

"This is what happens when you volunteer," he said.

MARKETS, CAMPAIGN IMPACTED

Trees were downed across the region, falling debris closed a major bridge in Boston and floodwater and gusts of wind buffeted coastal towns such as Fairfield, Connecticut, home to many commuters into New York City.

With eight days to go before the election, President Barack Obama and Republican challenger Mitt Romney canceled scheduled campaign events and acted cautiously to avoid coming across as overtly political while millions of people are imperiled.

U.S. stock markets were set to be closed on Tuesday. They closed on Monday for the first time since the attacks of September 11, 2001.

The federal government in Washington was closed and schools were shut up and down the East Coast.

NYSE Euronext said there had been no damage to the New York Stock Exchange headquarters that could impair trading floor operations but it was making contingency plans in case of such damage.

Sandy killed 66 people in the Caribbean last week before pounding U.S. coastal areas.

Advanced cancer patients overoptimistic about chemotherapy's ability to cure, study finds

ScienceDaily (Oct. 24, 2012) ? Findings from a nationwide study led by researchers at Dana-Farber Cancer Institute suggest that patients with advanced lung or colorectal cancer are frequently mistaken in their beliefs that chemotherapy can cure their disease.

The study, published in the Oct. 25 issue of the New England Journal of Medicine, found that 69 percent of patients with advanced lung cancer and 81 percent of patients with advanced colorectal cancer did not understand that the chemotherapy they were receiving was not at all likely to cure their disease. Their expectations run counter to the fact that although chemotherapy can alleviate pain and extend life in such patients by weeks or months, it is not a cure for these types of advanced cancer except in the rarest of circumstances.

The findings come from the Cancer Care Outcomes Research and Surveillance Consortium (CanCORS), a large nationwide study sponsored by the National Cancer Institute to understand many facets of cancer care in the United States. The study's lead author is Jane Weeks, MD, MSc, who is the CanCORS Consortium's scientific chair and is director of the McGraw/Patterson Center for Population Sciences at Dana-Farber, professor of medicine at Harvard Medical School and Professor of Health Policy and Management at Harvard School of Public Health.

The study was conducted by surveying 1,274 patients at hospitals, clinics and treatment centers across the country and by undertaking comprehensive review of their records. Study participants had been diagnosed with metastatic lung or colorectal cancer at least four months earlier and had received chemotherapy for their disease.

While previous studies had polled cancer patients about their perceptions of chemotherapy, this was the first to involve such a large and varied cross-section of the population. The study revealed that inaccurate expectations about the role of chemotherapy were found among patients from varied backgrounds treated in many different health care settings across the U.S.

Weeks noted that "If patients do not know whether a treatment offers a realistic possibility of cure, their ability to make informed treatment decisions that are consistent with their preferences may be compromised. This misunderstanding may pose obstacles to optimal end-of-life planning."

Surprisingly, patients who rated their communication with their physician highly were the most likely to hold overoptimistic views about chemotherapy's curative potential. While there is no doubt that communication about prognosis in advanced cancer is challenging, a sizeable minority of study participants did grasp the incurable nature of their cancers. Study co-author Deborah Schrag, MD, MPH, said that "skilled clinicians can set realistic expectations without their patients' losing either hope or trust." However, further research will be necessary to identify strategies to help physicians more consistently set realistic expectations and thereby help patients make good decisions about their care.

Other study co-authors include Paul Catalano, ScD, Angel Cronin, and Jennifer Mack, MD, MPH, of Dana-Farber; Matthew Finkelman, PhD, of Tufts University; and Nancy Keating, MD, MPH, of Brigham and Women's Hospital.

Forecasters warn East Coast about 'Frankenstorm'

WASHINGTON (AP) ? All the spare parts appear to be coming together to create what forecasters are calling "Frankenstorm," a monster combination of high wind, heavy rain, extreme tides and maybe snow that could cause havoc along the East Coast just before Halloween next week.

Hurricane Sandy, having blown through Haiti and Cuba on Thursday, continues to barrel north. A wintry storm is chugging across from the West. And frigid air is streaming south from Canada.

And if they meet Tuesday morning around New York or New Jersey, as forecasters predict, they could create a big wet mess that settles over the nation's most heavily populated corridor and reaches as far inland as Ohio.

With experts expecting at least $1 billion in damage, the people who will have to clean it up aren't waiting.

Utilities are lining up out-of-state work crews and canceling employees' days off to deal with the power outages. From county disaster chiefs to the federal government, emergency officials are warning the public to be prepared. And President Barack Obama was briefed aboard Air Force One.

"It's looking like a very serious storm that could be historic," said Jeff Masters, meteorology director of the forecasting service Weather Underground. "Mother Nature is not saying 'trick-or-treat.' It's just going to give tricks."

National Oceanic and Atmospheric Administration forecaster Jim Cisco, who coined the nickname Frankenstorm, said: "We don't have many modern precedents for what the models are suggesting."

Government forecasters said there is a 90 percent chance ? up from 60 percent two days earlier ? that the East will get pounded starting Sunday and stretching past Halloween on Wednesday. Things are expected to get messier once Sandy, a very late hurricane in what has been a remarkably quiet season, comes ashore, probably in New Jersey.

Coastal areas from Florida to Maine will feel some effects, but the storm is expected to vent the worst of its fury on New Jersey and the New York City area, which could see around 5 inches of rain and gale-force winds close to 40 mph. Eastern Ohio, southwestern Pennsylvania, western Virginia and the Shenandoah Mountains could get snow.

And the storm will take its time leaving. The weather may not start clearing in the mid-Atlantic until the day after Halloween and Nov. 2 in the upper Northeast, Cisco said.

"It's almost a weeklong, five-day, six-day event," he said from a NOAA forecast center in College Park, Md. "It's going to be a widespread, serious storm."

It is likely to hit during a full moon, when tides are near their highest, increasing the risk of coastal flooding. And because many trees still have their leaves, they are more likely to topple in the event of wind and snow, meaning there could be widespread power outages lasting to Election Day.

Eastern states that saw blackouts that lasted for days after last year's freak Halloween snowstorm and Hurricane Irene in late August 2011 are already pressuring power companies to be more ready this time.

Asked if he expected utilities to be more prepared, Massachusetts Gov. Deval Patrick responded: "They'd better be."

Jersey Central Power & Light, which was criticized for its response to Irene, notified employees to be ready for extended shifts. In Pennsylvania, PPL Corp. spokesman Michael Wood said, "We're in a much better place this year."

Some have compared the tempest to the so-called Perfect Storm that struck off the coast of New England in 1991, but that one didn't hit as populated an area. Nor is this one like last year's Halloween storm, which was merely an early snowfall.

"The Perfect Storm only did $200 million of damage and I'm thinking a billion," Masters said. "Yeah, it will be worse."

In the Caribbean, Sandy killed at least two people in Haiti before the 18th named storm of the Atlantic hurricane season passed over Cuba, ripping the roofs off homes and damaging fragile coffee and tomato crops.

Norje Pupo, a 66-year-old retiree in Holguin, was helping his son clean up early Thursday after an enormous tree toppled over in his garden.

"The hurricane really hit us hard," he said. "As you can see, we were very affected. The houses are not poorly made here, but some may have been damaged."

He always said he'd be back, and now, Arnold Schwarzenegger will be making his grand return to WWE as the Social Media Ambassador for the Oct. 8 episode of Monday Night Raw. Hot off the heels of the release of his highly anticipated autobiography, "Total Recall: My Unbelievably True Life Story,"?The Governator will bring his unique blend of wit, insight and honesty to the Twitterverse when he takes to the keyboard to offer commentary on the comings and goings of WWE Superstars this Monday night. What creative?quips will Schwarznenegger?have in store for the WWE Universe, as well as his recent Twitter adversary, Dolph Ziggler, on Monday night? Arnold gave us a glimpse of what's to come in a biting exchange of words with The Showoff on Friday night. It was Ziggler who took the first shot at the Hollywood megastar, and Arnold didn't hold back in his responses, as he offered up a very critical evaluation of?Mr. Money in the Bank. Members of the WWE Universe will have to keep their eyes peeled on Twitter to see how this newfound grudge develops from here.
